1. Who We Are

HSV Learn is operated by His Secret Vault Holdings LLC ("Company," "we," "us," or "our"), a U.S. limited liability company. Our platform provides AI-powered personalized education for children ages 2–16.

2. Acceptance of Terms

By registering for an account, accessing our services, or making a purchase, you agree to be bound by these Terms of Service and our Children's Privacy Policy. If you do not agree, do not use HSV Learn.

We reserve the right to update these Terms at any time. We will notify you of material changes by email or by a notice on the platform. Your continued use after changes take effect constitutes acceptance.

3. Eligibility & Parental Consent

• You must be at least 18 years old to create an account.
• All accounts are created by a parent or legal guardian ("Parent Account"). Children do not create their own accounts.
• By creating a child profile, you provide verifiable parental consent for the collection and use of your child's information as described in our Children's Privacy Policy, in compliance with the Children's Online Privacy Protection Act (COPPA).
• You are responsible for all activity that occurs under your account, including activity related to your child's profile.

4. Description of Services

HSV Learn provides:

• AI-powered tutoring via "Spark" and "Nova," powered by Anthropic's Claude models
• Interactive lessons across 15 subjects (availability depends on plan)
• Learning games, XP/progress tracking, and accessibility modes
• Parent dashboard with progress reports and account management

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

5. Subscriptions & Billing

• Free Plan: Available to all registered users with limited features.
• Paid Plans: Billed monthly on a recurring basis. By subscribing, you authorize us to charge your payment method on the same date each month.
• Price Changes: We will give at least 30 days' notice before changing subscription prices. Your continued subscription after a price change constitutes acceptance.
• Failed Payments: If a payment fails, your account will be downgraded to the Free Plan after a grace period. We will notify you by email.
• All payments are processed securely by Stripe, Inc. We do not store your full card details on our servers.

6. Cancellation & Refunds

• Cancellation: You may cancel your subscription at any time from the Parent Dashboard. Your access continues through the end of the current billing period. No partial refunds for unused time.
• 7-Day Money-Back Guarantee: If you are not satisfied within the first 7 days of a paid subscription, contact us at support@hsvlearn.com for a full refund.
• Exceptions: Refunds are not available after 7 days or if we determine the account was used in violation of these Terms.

7. Acceptable Use

You agree not to:

• Use HSV Learn for any unlawful purpose or in violation of any regulations
• Attempt to circumvent or disable any safety filters or parental controls
• Share account credentials with others outside your family
• Use automated tools to access or scrape the service
• Submit content that is harmful, abusive, obscene, or violates any third-party rights
• Attempt to reverse-engineer, copy, or create derivative works from our platform

Violation of these terms may result in immediate account suspension or termination without refund.

8. AI-Generated Content

Our AI tutors (Spark and Nova) generate responses in real time using large language models. While we implement safety filters and content moderation:

• AI responses are not guaranteed to be 100% accurate or error-free
• AI tutoring does not replace professional educational, psychological, or medical advice
• We are not liable for decisions made based on AI-generated content

9. Intellectual Property

All content on HSV Learn — including the platform design, lesson content, artwork, brand, and software — is owned by His Secret Vault Holdings LLC or our licensors and is protected by copyright, trademark, and other laws.

Your subscription grants you a limited, non-transferable, non-exclusive license to use HSV Learn for personal, non-commercial educational purposes only.

10. Privacy & COPPA

Our collection and use of children's personal information is governed by our Children's Privacy Policy, which is incorporated into these Terms by reference.

Parents may request access to, correction of, or deletion of their child's data at any time by contacting us at privacy@hsvlearn.com or using the data deletion feature in the Parent Dashboard.

11. Disclaimers

HSV Learn is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components.

Educational outcomes depend on many factors outside our control. We make no guarantee of specific learning results, grade improvements, or academic achievement.

12. Limitation of Liability

To the maximum extent permitted by applicable law, His Secret Vault Holdings LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of HSV Learn.

Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions.

Any dispute arising from these Terms shall first be addressed through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, conducted in English.

You waive any right to participate in a class-action lawsuit or class-wide arbitration.
